This website/application is a product of SRQ Companies, United Kingdom. While using our Application through website or mobile applications the user is bound to agree with the Terms & Conditions stated below. If you do not agree with any of the terms & conditions, then you may not access or use our services. Any new features or tools which will be added to this App/Website shall be subject to the Terms & Conditions. You can review the most recent version of Terms & Conditions at any time in this section. Please ensure that you read and understand these terms & conditions before you sign in to the App. The acceptance of the user terms shall be deemed to include your acceptance of our privacy policy available at https://gotraq.co/privacy-policy.

By agreeing to these Terms & Condition, you agree that

1. You are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor will you violate any laws in your jurisdiction (including but not limited to copyright laws).

2. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the app/website through which the service is provided, without expressed written permission from us.

3. You must not transmit any worms or viruses or any code of a destructive nature. Breach or violation of any of the Terms will result in an immediate termination of our Services.

4. The registration data you enter or given to the travel agent is accurate, because some of the data you provide will be used to contact you or your relative in cases of emergency.

5. The responsibility of the confidentiality of your login credentials will entirely be yours. Any activity done in your account while you are logged in will be considered to be done by you.

6. We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

7. GoTraq is an Application both mobile and web, that allows the tour operators/travel agents to create travel groups of pilgrims and a trip coordinator (a guide for the group, who would be the tour operator/travel agent’s employee). The Tour Operator/travel agent will monitor the pilgrim’s whereabouts during the tour through getting the group member’s gps location and sharing this with all the group members. This will enable any lost pilgrim to get back to any of the group members by tracking their gps location. Similarly at times when the lost pilgrim is in an emergency, the trip coordinator or the other members of the group can track him and reach him for help. GoTraq also gives a feature where the pilgrim can nominate one of his family member or a friend to monitor their whereabouts.

8. Therefore you as a user of the App are permitting GoTraq to collect your precise location details and share it with the other members of the App as long as you are logged in, irrespective of the App being open or running in the background.

9. You will not use an account that is subject to any rights of a person other than you without appropriate authorization.

10. You will only use an authorized network to avail the Service.

11. GoTraq or an authorized representative of us, shall provide information regarding services, discounts and promotions provided by GoTraq to you on the App or by way of an SMS or email to your registered mobile number/registered email ID. You also have the option to discontinue receiving such information at any point of time. To discontinue you can send a request through the contact us option.

12. GoTraq will be entitled to process and transfer your information as and when it deems fit and it may store or transfer your information in a server outside your country in order to perform GoTraq’s obligations under these customer T&C.

13. You agree and permit GoTraq to share any information provided by you with third parties( such as Google Maps) in order to facilitate provision of certain value-added services offered by such third parties to you and/or to provide certain value-added services to you by GoTraq.

14. GoTraq will be entitled to enter into any tie-up in terms of joint-venture or otherwise with any other institution engaged in the business of providing services analogous and/or similar to those herein contained. In such case, depending upon the modality and the mechanism as may be devised, you will be provided with the services by GoTraq jointly and/or severally with the party/ies in joint venture. You hereby give your irrevocable consent and permission to such a tie-up. In the event of such a tie-up, the terms and conditions herein contained will, mutatis mutandis, become applicable in respect of such tie-up arrangement also.

15. GoTraq shall provide a price breakdown of the total purchase amount payable by you in the Cart including the discount and taxes applicable and give you an option to accept and continue. Once you continue it directs you to the payment gateway page. This continuation is deemed to be taken as your acceptance of all the prices mentioned.

16. GoTraq provides a feature of SOS for the pilgrim in cases of emergency. This would send a notification to the trip coordinator and the travel agent. It is the sole responsibility of the tour operator/travel agent to take effective steps to provide immediate assistance and GoTraq will not be held responsible for any mismanagement of the situation.

17. Any cancellation of subscription is to be requested through the contact us section in the App. The decision of refund of the payments done in case of cancellation will solely be at GoTraq’ s discretion depending on the reason of cancellation.

18. By accepting these User Terms and using the Service, you agree that you shall defend, indemnify and hold GoTraq, its affiliates, harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these User Terms or any Applicable Law or regulation, whether or not referenced herein. (b) Your use or misuse of the Application or Service.

19. Prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue the service (or any part or content thereof) without notice at any time. Certain products or services may be available exclusively available in a part of the world because of being limited in quantity or quality of service. We reserve the right to limit the quantity of any product or service.

20. The material on this website/App is provided for general information only and should not be relied upon or used as the sole basis for making decisions. Any reliance on the material on this app/website is at your own risk. We reserve the right to modify the contents of this app/website at any time. You agree that it is your responsibility to monitor changes to our app/website.

These Terms & Conditions and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of United Kingdom.
